A Regulation 51 statement is a legal document that forms part of the Section 32 Sale of Land Act and your building permit. You need it when you are buying or selling your property.
There are three types of statements:
Regulation 51(1)
- Details of any Building Permit or Certificate of Final Inspection issued in the preceding 10 years;
- Details of any statement issued underregulations 64, 65, 66, 67 & 231, 232 of the Building Regulations; and
- Details of any current notice, order, certificate or statement issued under the Act or Building Regulations.
Regulation 51(2)
- Land liable to flooding (Reg. 153, Special Building Overlay);
- Land prone to termites (Reg. 150);
- Land prone to significant snowfalls (Reg. 152);
- Designated land or works (Reg. 154, Land Subject to Inundation Overlay); and
- Designated bushfire prone area (Reg. 156).
Regulation 51(3)
- An owner or mortgagee of a building or land, or a prescribed building practitioner under section 137B of the Act, may request the relevant council to provide inspection approval dates of the mandatory notification stages for building work carried out on that building or land.
